Transport Responsibility

In September 2005, the new Compliance and Enforcement legislation was released. This legislation specifies that all parties involved in road transport activities may be held responsible for breach of road laws.

These activities could include any of the following:

  • Consigning – a person or company commissioning the carrying of goods.
  • Packing – placing goods into packages, containers or pallets.
  • Loading – placing or restraining the load onto a vehicle.
  • Driving – the physical act of driving a heavy vehicle.
  • Operating – conducting a business which controls the use of heavy vehicles.
  • Receiving – paying for the goods or taking possession of the load.



The new legislation also recognises the responsibility of 'Off the Road' parties in the supply chain. This means that if a breach of road laws occurs due to any party's actions, inactions or demands, they may be legally liable.
